All prices are subject to change without notice. All SpectraUSA merchandise will be billed at the prices maintained by SpectraUSA at time of billing. If a human, internet or technical error occurs and a product is listed at an incorrect price, SpectraUSA maintains the right to refund, update the price correctly or cancel orders which have been placed at the incorrect price.

Styles, Colors and Inventory

Based on demand and sales, SpectraUSA reserves the right to discontinue styles, colors and size without any prior notification. SpectraUSA cannot guarantee variances in color, shade, size, or construction of merchandise.  SpectraUSA hereby disclaims all express and implied warranties, including, without limitation, implied warranties of merchant-ability and fitness for particular purpose. All such warranties are hereby disclaimed and excluded from any and all transactions between the customer and SpectraUSA and shall not apply to the merchandise sold by SpectraUSA.

Garment Specifications

Please note that Spectra USA makes periodic updates to its garment specifications. Our current inventory may include a balance of garments from a previous specification.

Spectra USA ships by FIFO accounting practice (First In First Out) and ships only one garment specification per order.

Order Placing and Shipping

Most in-stock, credit approved orders are shipped on the same day that they are placed–when placed prior to 11.30 am. Please speak to your sales representative for your shipment date confirmation. Additions to orders already placed will be considered a “new order” and processed as a new purchase order.


If you did not receive a confirmation, we did not receive your order.

Spectra USA will not pay for rushed shipments on orders that were not verified. Please contact your sales representative if you did not receive a confirmation.

Shipping Issues

Spectra USA will not be responsible for non-delivery, delay, loss, or damages during shipment. All merchandise is shipped FOB (Free On Board) origin. Insuring the product is the responsibility of the buyer, not the responsibility of Spectra USA.

Customer Acceptance of Late/Defective Merchandise

The customer's failure to provide written notice of a claim, as set forth in these Terms and Conditions of Sale, shall constitute a waiver of any claim the customer may have for damages resulting from such defects, including late delivery.

Limited Liability

The customer acknowledges that SpectraUSA shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages including but, not limited to, damages for loss of profits, goodwill, or other intangible losses (even if SpectraUSA has been advised of the possibility of such damages), or personal injuries or death resulting from use or sale of the SpectraUSA's merchandise.

SpectraUSA shall not be liable for any work performed by any third party vendor referred by SpectraUSA and, the customer hereby waives any right to assert any claim against SpectraUSA for work performed by any other third party or vendor, including but not limited to claims for negligent referral, agency, or respondent superior.

Force Majeure

Neither the customer nor SpectraUSA shall be liable to the other for delays in performance of its obligation here-under caused by acts of God, war (declared or undeclared), government regulation, terrorism, disaster, strikes, civil disorder, curtailment of transportation facilities, or similar occurrence beyond the party's control, making it impossible, illegal, or commercially impracticable for one or both parties to perform its obligations under these terms and conditions of sale, in whole or in part.

Pick-up and Delivery

A customer pick-up service is available from 8:00 am to 3:00 pm, Monday through Friday. Please contact your customer service representative to confirm that your order is available for collection before collecting it.

All freight claims for missing or damaged merchandise must be filed directly with the carrier except for UPS and FED-EX shipments.

Shipping Inconsistencies

Due to possible human error, it is the buyer/consignees' responsibility to verify that the merchandise received matches what was ordered and to resolve any claims with Spectra USA before garments are altered. Spectra USA will not accept any claims if garments are altered due to incorrect shipments.

Enhanced Product

It is the buyer’s responsibility to thoroughly inspect and test all merchandise before washing, printing, or any type of alteration or decoration is applied. The embellishment processes conducted by the buyer are beyond the control of Spectra USA. Thus, once merchandise is altered in any way, shape or form, the buyer cannot return or make any exchanges.

Claims and Cancellations

It is the buyer’s obligation to inspect and test all merchandise before washing, printing, or any type of decorating. Once our t-shirts are altered in any way by the printer, re-labeler, embroiderer etc, the Buyer cannot return the garments or make any exchanges.

Notification of Defects

The customer is responsible for inspecting the merchandise upon receipt.  The customer shall notify SpectraUSA in writing within 5 DAYS of receipt of the merchandise of any claims for damages or any defect in the merchandise discovered by the customer, including, without limitation, claims related to shortages, quality, or specification.

Under no circumstances will SpectraUSA accept claims or returns of merchandise which has been altered, laundered, or modified in any manner.  Unless directed otherwise by a customer representative, all damaged or incorrect items will need to be sent back to SpectraUSA for inspection and possible credit. Please see return procedure below.

Return Policy

Authorized returns and exchanges must be postmarked within 5 DAYS after Customer's receipt of merchandise.  All returned merchandise requires a completed Return Form which can be obtained from our Returns department (see below). The customer shall be responsible for all freight and shipping charges on items the customer wishes to return, which are not the result of a SpectraUSA error. SpectraUSA is not responsible for any lost shipments on items customers are trying to return. SpectraUSA will only cover the shipping costs for exchanged items when the exchange is due to SpectraUSA’s error.  Returns and exchanges are not available for sale or discounted items. All sale, discount or markdown items are final sale only, sale or markdown items cannot be returned or exchanged.  Returns will not be accepted on merchandise that has been altered, laundered or modified in any way.  SpectraUSA cannot pursue any claim for credit or exchange without first taking receipt of the original garment intended for exchange.

SpectraUSA is headquartered in the State of California, United States of America.  These terms and conditions shall be governed by, and interpreted, under the laws of the State of California (without regard to its conflicts of laws principles) and the federal laws of the United States of America.  If any provision of these Terms and Conditions of Sale is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Use, which shall remain in full force and effect.
The customer expressly agrees that exclusive jurisdiction for any dispute with SpectraUSA, or in any way relating to these Terms and Conditions of Sale, resides in the courts of the State of California and the customer further agrees and expressly submits to the personal and exclusive jurisdiction of the courts of the State of California in connection with any such dispute including any claim involving the merchandise or SpectraUSA or its affiliates, subsidiaries, employees, contractors, officers, directors.
